Container Summary

2 copies of a Typed Manuscript, undated, from Henry Bartholomew Cox titled "The Caveat Emptor Principle in Public Records," stating a history of private protection of public records in the face of uneven government efforts to protect records from 15th Century England through late 20th Century America and the aftermath of the West case. Cox argues that the West case now positioned archives to preserve public records, overriding the interests of private individuals and simultaneously ignoring the role private individuals played in the success of the modern archival movement by saving documents from official neglect or disposal. Cox concludes his manuscript by expressing hope that the West case will unite archivists with private manuscript and autograph collectors in search of a solution that preserves historic documents and minimizes the need for replevin actions.
